The audit will comprise 18 entities. It will be carried out in the Police, Central Anti-Corruption Bureau, secret services (all except for the Intelligence Agency) but also e.g. in the Ministry of Finance, Office of Electronic Communications, selected courts and prosecutor’s offices. NIK will focus on reviewing internal procedures in particular institutions. The auditors will check how the secret services use their rights, how they supervise the way billings are obtained, processed and destroyed and also how they secure the data obtained from billings.
The audit is supposed to answer the question: are the Polish regulations sufficient to make sure the citizens’ rights are observed. The NIK auditors will not verify if the requests for billings in individual matters were justified. This is not allowed by the Act on the Supreme Audit Office. NIK does not exclude, though, that after the end of the audit it will apply for a court review which is to check if the secret services and the Police’s requests for billings are legitimate.
