Lawyers from all around Poland met at the following National Bar Convention in Katowice. The Supreme Bar Council invited NIK President Krzysztof Kwiatkowski to attend the meeting. President Kwiatkowski specified areas of potential cooperation with the bar. Among others he quoted the last audit results revealing excessive interference of the state in citizens’ rights and freedoms. NIK had checked how special services, courts and prosecutor’s offices obtain and process telecommunications and IT data. NIK stands in the position that this area has to be regulated in statutory terms. NIK expects the Polish bar of lawyers to use its experience and join the process of structuring the phone records cases. President Kwiatkowski referred to the post-audit recommendations setting out directions of the future law: establishing external audit over the process of obtaining phone records data, creating a catalogue of cases for which the telecommunications data may be acquired and introducing instruments making sure the data are destroyed when they are no longer necessary for the proceedings in question.
