Zamówienia wyłączone ze stosowania ustawy – transgraniczny charakter towarów i usług

Wartość polskiego rynku zamówień publicznych w 2021 roku wyniosła ok. 297,8 mld złotych i obejmowała także te wyłączone ze stosowania ustawy – Prawo zamówień publicznych (Pzp), szacowane na ok. 113,2 mld złotych. Segment zamówień udzielanych w takim trybie stanowił więc ponad 38% całego rynku. Na te wielkości miała niewątpliwie wpływ znacząca liczba wyłączeń zawarta w ustawie Pzp, przekraczająca 60 samodzielnych podstaw. Ich źródła należy upatrywać w unijnym i krajowym prawie zamówień publicznych. Artykuł przybliża te regulacje, akcentując obowiązki zamawiających.

ABSTRACT

Procurement Excluded from the Resolution Application – Transborder Nature of Goods and Services

The volume of the public procurement market in Poland in 2021 stood at about PLN 297.8 billion, which also comprised the procurement excluded from the application of the provisions of the Act – Public Procurement Law, amounting to about PLN 113.2 billion. Therefore the segment of the public procurement granted with the exclusion of the Act reached over 38 percent of the whole market in 2021. Annually, there are about 130,000–140,000 such procurements granted. Such a big volume undoubtedly stems from the number of exclusions in the Act – Public Procurement Law, which exceeds 60 separate basis. These are exclusions stemming from the EU law on public procurement, as well as from strictly national exclusions. The article attempts to describe the responsibilities set forth in the EU law, as well as those stemming from the national law. Better knowledge of these conditions will contribute to the cohesion of the Polish public procurement system.
