Biogaz i biometan – niewykorzystane szanse transformacji systemu energetycznego – OZE niezależne od pogody

NIK dotychczas nie przeprowadzała kompleksowych kontroli obejmujących zagadnienia związane wyłącznie z wytwarzaniem energii z biogazu, biogazu rolniczego i biometanu. Wyniki opisywanego badania potwierdziły, że rozwój odnawialnych źródeł energii (OZE) na bazie stabilnych i sterowalnych źródeł energii, niezależnych od pogody, jest istotny i może odegrać ważną rolę w procesie transformacji energetycznej w Polsce. Głównym celem kontroli, przeprowadzonej z własnej inicjatywy przez Śląską Delegaturę NIK w Katowicach w latach 2024–2025, było sprawdzenie, czy możliwości (potencjał) wytwarzania i zastosowania biogazu, biogazu rolniczego i biometanu do celów produkcji energii są w Polsce efektywnie wykorzystywane. Cele szczegółowe dotyczyły zagadnień pozwalających na dokonanie oceny m.in.: polityki państwa, pod kątem sprzyjania przyjętych założeń w zakresie rozwoju wykorzystania biogazu, biogazu rolniczego oraz biometanu w celach energetycznych; dostępnych systemów wspierających wytwarzanie energii z tych paliw, w zakresie ich skuteczności oraz rzetelności i legalności realizowanych przez odpowiednie organy państwa działań; dostępnych środków finansowych przeznaczonych na wykonanie inwestycji związanych z wytwarzaniem wymienionych wyżej paliw (pochodzących zarówno z programów unijnych, jak i budżetu państwa, samorządu terytorialnego lub innych państwowych osób prawnych) w zakresie ich celowego i gospodarnego wykorzystania przez beneficjentów. Kontroli poddano: Ministerstwo Klimatu i Środowiska (MKiŚ); Ministerstwo Rolnictwa i Rozwoju Wsi (MRiRW); Urząd Regulacji Energetyki (URE) (NFOŚiGW); Krajowy Ośrodek Wsparcia Rolnictwa (KOWR). Kontrolą objęto również sześć przedsiębiorstw (spółek), które: zrealizowały inwestycje polegające na budowie, przebudowie i/lub modernizacji instalacji OZE wykorzystujących w procesie wytwarzania energii biogaz i/lub biogaz rolniczy; wykorzystały na te cele środki publiczne przyznane w ramach funduszy unijnych i/lub krajowych; ukończyły etap realizacji tych przedsięwzięć oraz prowadziły działalność polegającą na wytwarzaniu energii elektrycznej i/lub cieplnej z wykorzystaniem wspomnianych paliw; rozliczyły otrzymane dotacje i pożyczki oraz nie przekroczyły okresu trwałości wynikającego z zawartych umów o dofinansowanie.

ABSTRACT

Biogas and Biomethane – Missed Opportunities of Energy System Transformation: Weather-Independent Renewable Energy Sources

To date, the Supreme Audit Office has not conducted comprehensive audits dedicated exclusively to issues related to energy generated from biogas, agricultural biogas and biomethane. The results of the audit presented in the article confirmed that the development of renewable energy sources (RES) based on stable and controllable weather-independent energy sources is important and may play a significant role in Poland’s energy transition. The main objective of the audit, carried out on the initiative of the Regional Branch of NIK in Katowice in the years 2024–2025, was to determine whether Poland effectively used its potential to produce and use biogas, agricultural biogas and biomethane to generate energy. The specific objectives of the audit concerned, among other things, the issues allowing to assess the state policy in terms of whether it supported the adopted assumptions for developing the use of biogas, agricultural biogas and biomethane for energy purposes; the available support schemes for energy produced from these fuels, including their effectiveness and reliability and legality of the measures taken by relevant state authorities; as well as the financial resources available for investments related to the production of the these fuels (from EU programmes, the state budget, local government budgets or other state legal persons), in terms of whether beneficiaries used them in a purposeful and economical manner. The audit comprised the Ministry of Climate and Environment (MKiŚ), which performs tasks including the formulation of state policy on climate and renewable energy; the Ministry of Agriculture and Rural Development (MRiRW), with regard to tasks related to rural development in the context of renewable energy, with particular emphasis on biogas and biomethane installations; the Energy Regulatory Office (URE), as the institution responsible, among other things, for providing support for energy generated from renewable sources; the National Fund for Environmental Protection and Water Management (NFOŚiGW), which implements sectoral programmes providing financial support for investments involving the construction or modernisation of renewable energy installations; and the National Support Centre for Agriculture (KOWR), with regard to its responsibilities for promoting and supporting activities involving agricultural biogas plants. The audit also covered six enterprises (companies) that had carried out investments involving the construction, reconstruction and/or modernisation of renewable energy installations using biogas and/or agricultural biogas in the energy generation process; used public funds granted under EU and/or national funding programmes for these purposes; completed the implementation stage of these projects and conducted activities involving the generation of electricity and/or heat using the fuels referred to above; and accounted for the grants and loans received without exceeding the durability period arising from the relevant funding agreements.
